1. OVERVIEW

 1.1 These terms and conditions govern the sale of products by SONO LUXE LTD ("we" or "us") to you, the customer.

3. INTERPRETATION

3.1 ROLE OF SONO LUXE LTD: By using our platform, you acknowledge that SONO LUXE LTD serves solely as an intermediation platform between buyers and sellers. With the exception of specific circumstances, SONO LUXE LTD does not act as a reseller of the products nor does it ever become the owner of the products. Private sellers, acting at all times for and on their own behalf, never act as an agent or representative of SONO LUXE LTD. As such, SONO LUXE is not a party to the contract of sale between the buyer and the seller and disclaims all liability for such a contract or its consequences.

4. YOUR ORDER

4.1 UNABLE TO ACCEPT YOUR ORDER: We strive to ensure a seamless ordering process; however, if we are unable to accept your order, we will notify you in writing without charging you for the product. This could be due to a variety of reasons, such as the product being out of stock, unexpected limitations on our resources that we could not reasonably plan for, failure to meet our minimum credit requirements, errors in product pricing or description, failure to provide requested documentation for identity and order verification, or inability to meet your specified delivery deadline.
4.2 ORDER CONFIRMATION: Upon acceptance of your order, we will provide you with an order number that you should reference in all communications regarding your order.

5. PRODUCTS

5.1 PRODUCT VARIATIONS FROM IMAGES: The product images displayed on our website are for illustrative purposes only, and the actual products may vary slightly from the images shown. Although we have made every effort to accurately display the colours, we cannot guarantee that your device's display accurately reflects the colours of the products. Therefore, your product may vary slightly from the images shown.
5.2 PACKAGING VARIATIONS: The packaging of the product may differ from the images displayed on our website.

6. CANCELLATION

PLEASE BE ADVISED THAT AFTER PLACING AN ORDER, IT IS NOT POSSIBLE TO CANCEL OR MAKE ANY CHANGES TO IT.

7. DELIVERY

7.1 DELIVERY COSTS: The delivery costs will be clearly displayed on our website for your reference.
7.2 DELIVERY TIMELINE: We will notify you of the estimated delivery date during the order process. We will endeavour to deliver the products to you as soon as reasonably possible and within 30 days of the date of order acceptance.
7.3 UNCONTROLLED DELAYS: In case the delivery of products is delayed due to events outside our control, we will notify you as soon as possible. We will not be responsible for delays caused by such events, however, if there is a risk of significant delay, you may contact us to terminate the contract and receive a refund for any products you have paid for but not yet received.
7.4 MISSING DELIVERY: If you are not available at the delivery address during the scheduled delivery time and the products cannot be delivered through the letterbox, our logistics partners will notify you via email or text with instructions on how to reschedule the delivery. Please be aware that our logistics partners will make up to three delivery attempts. If they are unsuccessful after three attempts, please contact us for further assistance.
7.5 RESPONSIBILITY FOR GOODS: The product will become your responsibility as soon as we deliver it to the address you provided or when you or a carrier arranged by you collects it from us.
7.6 OWNERSHIP OF GOODS: Ownership of the product will be transferred to you only after we have received full payment for it.

7.7 FAILED PROVIDE RELEVANT IFORMATION: If you fail to provide us with the necessary information to supply the products, we may be unable to complete your order. In order to process your order, we may need certain information from you, such as personal identification documents and a proof of address in the form of a redacted bank statement. We will contact you in writing to request this information. Failure to provide the requested information within a reasonable timeframe or providing incomplete or inaccurate information may result in termination of the contract or an additional reasonable charge to compensate for any additional work required. We will not be responsible for any delay or failure to supply the products if you fail to provide us with the necessary information within a reasonable time frame.

8. YOUR RIGHTS TO CANCEL THE CONTRACT

8.1 SALES ARE FINAL FOR ITEMS MARKETED ON OUR WEBSITE. Our platform facilitates transactions between individual private sellers and buyers, and SONO LUXE LTD operates solely as an online marketplace on their behalf. Legal ownership of the items sold on our website (www.sonoluxe.co.uk) remains with the individual private sellers until the sale is completed. Therefore, we cannot accept returns, refunds, or exchanges for any items purchased through our website.
8.2 CONTRACT CANCELLATION. You have the right to cancel your contract with us, subject to the provisions outlined below.
8.3 RIGHT TO CANCEL DUE TO NOT AS DESCRIBED PRODUCTS: If the product purchased is found to be not as described, the purchaser reserves the right to terminate the contract within 30 days from the date of purchase. If you have a dispute with us about an item you purchased, we request for two opinions from separate companies that disagree with our original evaluation. We will also need supporting documentation to show that the findings are related to the item in question. Please noted that Upon such termination, any products that have already been dispatched or received must be promptly returned to the seller as request.
8.4 RETURN COSTS: If the products not as described, we will cover the costs of returning them and provide the pre-paid label on our end.
8.5 REFUND PROCESS: if the products not as described, we will process your refund for the price you paid for the returned products within 28 days of receiving them. The refund will be issued using the same payment method you used for your original purchase. Additionally, please note that any shipment fees of sales are non-refundable.
8.6 POSSIBLE DEDUCTIONS FROM REFUNDS: Please be aware that if the returned products are damaged or used, or if there are other valid reasons for a deduction, we may subtract an amount from your refund. We will notify you of any deductions before we process the refund.

9. OUR RIGHTS TO END THE CONTRACTS

9.1 WE RESERVE THE RIGHT TO TERMINATE THE COTRACT AT ANY TIME TO YOU IF:
A. You fail to provide us with the necessary information to fulfil the order, such as identification or verification documents, within a reasonable time of our request;
B. we are unable to fulfil the order due to certain circumstances.

10. PRICE AND PAYMENT

10.1 PRICE INFORMATION: The price of the product, which includes VAT, will be displayed on the order pages at the time of purchase. We take necessary measures to ensure that the price displayed is accurate.
10.2 VAT RATE CHANGES: If there is any change in the VAT rate between the order date and the date of product supply, we will adjust the VAT rate accordingly unless you have already made a full payment before the change in VAT rate.

11. OUR RESPONSIBILITY FOR LOSS OR DAMAGE

A. We are responsible for any foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill. However, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious or if we both knew it might happen when the contract was made.
B. Our total liability in connection with the product or any breach, whether in contract, tort, breach of statutory duty or otherwise, shall not exceed the value of the relevant order.
C. We only supply products for domestic and private use. Therefore, we are not liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity if you use the products for commercial, business or re-sale purposes.

12. OTHER TERMS

12.1 Please notice that It is an agreement between" you" and "SONO LUXE LTD", and no other individual has the right to enforce any of its terms.

12.2 If any part of this contract is found to be illegal, the remaining terms will remain valid and in force. Each paragraph of these terms operates independently, so if any of them are deemed unlawful by a court or relevant authority, the other paragraphs will still apply.
12.3 Even if we don't immediately enforce this contract or take action against you for not complying with its terms, we can still enforce it later. Failure on our part to insist on immediate compliance with any part of this contract won't release you from your obligations, and we can still take action against you at a later time. For example, if you miss a payment and we don't contact you, but still provide products, we can still require you to make the payment at a later date.
12.4 This contract is governed by English law, and if you need to take legal action regarding the products, you can do so in English courts.
